Products shall be delivered by mean of courier to the address provided on the Order by the Client. The production of the order takes maximum 15 working days and the delivery of the Products will take place in about 2 (two) days in Italy and 5 (five) days outside Italy of the sending date by Zigozago .The delivery dates listed on the Site are purely as an indication and not binding for Zigozago If one or more Products, subsequent to the Order, became unavailable, Zigozago may proceed with the delivery of the other Products; should this be the case, partial delivery of Products is meant to be valid and cannot entitle the Client to the opting-out clause nor to any kind of indemnity or reimbursement. The property and risk of Products pass to the Client at the moment of delivery to the address specified on the Order by the Client.

Art. 1 DEFINITIONS 1.1. “Site” refers to the internet web site www. Zigozago.it related to the sale of Zigozago products; 1.2. “Client” refers to the individual who has ordered the Products under the present terms and conditions of sale. 1.3. “Zigozago.” refers to Zigozago, with its statutory seat at Via Valle 14/A - 21037 Ponte Tresa (VA) - Italy , company enrolled at the Italian Registry of Trade and Companies under VAT n. 02115830180 . 1.4. “Order”, refers to the request form about goods or services offered by Zigozago, submitted by the Client to Zigozago through the Site. 1.5. “Products” refers to goods and services specified in the Order sold or supplied by Zigozago under this Contract. 1.6. "Price" refers to the consideration for the Products and the delivery cost, as specified in the Contract. 1.7. "Contract" refers to the Products contract of sale, regulated by the present general terms and conditions. 1.8. “Parties" refers to Zigozago and the Client. Art. 2 PRODUCTS SALE 2.1. The Products are sold and supplied under the terms and conditions provided by the Contract published on the Site at the time of the Order. 2.2. The Contract is concluded and binding to both Parties, when the order confirmation forwarded by Zigozago to the e-mail address provided by the Client with his/her registration to the Site. 2.3. The Site offers also the sale of personalized Products (Personalized Products), whose realization is submitted to a prior Client request, given throughout instructions written on the Site. The opting-out clause for such Personalized Products is not allowed. 2.4. Prices and Products are subject to change in any moment with no prior notice. Art. 4 CLIENT OBBLIGATIONS 4.1. The purchase of Products through the Site, requires the Client to write all data necessary to the delivery. To registration purpose, requested at the time of the first purchase, the Client undertakes to communicate his/her correct personal data and general information required to the Products purchase. 4.2. The Client undertake to pay the Price of the purchased Products and to keep copy of the confirmation order send to the e-mail address provided by the Client at the time of his/her registration at the Site. Art. 5 PRICE AND PAYMENT OF THE PRICE 5.1. The Prices are expressed in euro (€) and are meant to be VAT included. 5.2. The total Price displayed on the Order, includes the delivery expenses but not the customs charges and any other sale tax, that the Client undertakes, since now, to pay in addition to the Price according to the country law in which the Products will be delivered. 5.3. The payment of the Products must be entirely executed: • At the Product's delivery if the payment is agreed to be “cash at delivery”; in such cases the payment are allowed if executed in cash and just inside the Italian territory; • At the time of the supply of the Products, if payment is agreed to be executed by credit card. Art. 6 FORCE MAJEURE 6.1. The Parties will not be answerable for the delay in the performance of their obligations, according to the Contract, if said delay is caused by circumstances out of their reasonable control. The Party late for force majeure will have the right to a reasonable extension of time to perform such obligations. Art. 7 COPYRIGHT & TRADEMARKS 7.1. Any trademark, logotype and distinctive mark utilized in the Site, are of the each owner's propriety. 7.2. All trademarks, logotypes and distinctive marks of the Site cannot be used nor reproduced by any non authorized third party. 7.3. All contents of the Site such as information, text, design are protected by the intellectual property according to the Italian and international normative in force. Art. 8 OPTING OUT CAUSE 8.1. In accordance with the provisions set forth by the Italian Law (art. 5 D. Lgs. 22 May 1999 n. 185 and D. Lgs. 15 January 1992 n. 50 ), the opting out clause entitle the Client to withdraw form the Contract by returning the Products. The Client shall be then reimbursed of the Product Price. 8.2. The opting-out clause is applicable only to the individuals who acts for purposes not referred to their professional services and activities. Therefore the opting-out clause cannot be applied to resellers and companies. 8.3. The right to contracting out is exercised within 10 working days, by means of a written communication to the address: Zigozago Via Valle 14/A - 21037 Ponte Tresa (VA) - Italy . The communication can be sent, within the same term, also by fax +39 0381 5599169 and e-mail info@zigozago.it . 8.4. In order to validly exercise the contracting out right the Client is obliged to send the Products back to Zigozago. The Products shall be well packed so to keep save the original packing and mark stamped on them. 8.5. The Products shall be returned to: Zigozago Via Valle 14/A - 21037 Ponte Tresa (VA) - Italy . Zigozago. will render what has been paid by the Client, within 30 (thirty) days from the moment of the reception of the Products re-sent by the Client to Zigozago, if the Products are represented by goods. 8.6. The reimbursement does not include transportation costs both for the delivery or replacement of the Products. Art. 9 PRIVACY 9.1. The personal data communicated, in order to execute the Agreement, by the Client to Zigozago will be processed in accordance with provisions of Italian Law (D. Lgs. 2003 n. 196) regarding the privacy protection. Art. 10 ENTIRE AGREEMENT 10.1. The Contract replaces all the contracts, the engagements and the agreements previously intervened between the Parties and, together with the Order, the general conditions about the use of the Site and the conditions of the registration service, to be considered here expressly reproduced, constitutes the entire agreement between the Parties regarding the subject of the Contract. 10.2. Any variation or change to the Contract will have to be approved in the form of written evidence by both Parties. Art. 11 COMMUNICATIONS 11.1. All the communications between the Parties must be in written form and sent to the address of the other party indicated by the Contract and the Order. The Parties undertake to consider as sent in written form the communication sent by e-mail to the address of the other part indicated in the Site and in the Order. 11.2. The communications that impact on the validity or on existence of the Contract must be exclusively delivered by hand or registered letter with notice of reception. Art. 12 LANGUAGE^ 12.1. The Contract is drawn up in the Italian language, with an English translation for informative purposes only. In the event of any discrepancies, the Italian version shall prevail. Art. 13 APPLICABLE LAW AND JURISDICTIONS 13.1. The Contract will be governed by and interpreted in accordance with the laws of Italy . 13.2. Any controversy arising from the Contract will be subject to: a) the jurisdiction of the Court where the Client has his/her residence or domicile if the Client, according to the laws in force, is a consumer and has his/her residence or domicile in Italy; b) the exclusive jurisdiction of the Court of Varese, Italy, in any other case.

Lgs. 15 January 1992 n. 50 ), the opting out clause entitle the Client to withdraw form the Contract by returning the Products. The Client shall be then reimbursed of the Product Price. The opting-out clause is applicable only to the individuals who acts for purposes not referred to their professional services and activities. Therefore the opting-out clause cannot be applied to resellers and companies. The reimbursement does not include transportation costs both for the delivery or replacement of the Products.
